The Tenancy Law of Lagos State 2011 governs most of the metropolis, though a handful of high-end districts — Apapa, Ikeja GRA, Ikoyi and Victoria Island — were excluded from parts of the Law. Beyond the 12-month advance cap for new tenancies, it makes it unlawful for a landlord to demand more than one year's rent in advance and sets out graduated notice periods: a week for a tenant at will, a month for a monthly tenancy, three months for a quarterly tenancy and six months for a yearly tenancy, followed by a seven-day notice of the owner's intention to recover possession.

A compliant Lagos tenancy agreement should state the parties, the property description, the term and rent, the payment schedule, and each side's repair obligations, and should be signed before witnesses. Recording the agreed service charge — which in serviced estates on the Island covers security, generator diesel and estate maintenance — prevents the disputes that most often send Lagos tenancies to the Magistrate or Tenancy Court.

After that notice expires the landlord must serve a further seven-day notice of intention to recover possession before applying to the Magistrate or Tenancy Court. Contracting for a different notice period in the tenancy agreement is allowed, which is why the written terms matter.

Parts of the Tenancy Law of Lagos State 2011 expressly exclude certain high-value areas — Apapa, Ikeja GRA, Ikoyi and Victoria Island — reflecting their largely corporate and expatriate tenancies. In those districts landlords have more freedom over advance rent and terms, so tenants rely on the negotiated agreement rather than the statutory protections. Everywhere else in the state the Law's advance-rent cap and notice provisions apply, and a well-drafted agreement should state which regime governs the tenancy.
